TEACHER APPRECIATION RULING:
 
Below is a note from the Texas PTA Treasurer clarify a statement made at SLS regarding Teacher Appreciation and the use of PTA funds:
 
I think a lot of that discussion came about  concerning the number of times and the portion of the budget allocated to staff appreciation.  In my workshop I said two or three times a year providing a nominal dinner (pizza, Jason's deli, etc, back to school luncheon at the school) was okay.  Dinners at restaurants, steak houses, country clubs, etc probably are not.  This goes for PTAs that spend money to feed the board also.

 

We need to remember what our mission is and how the IRS interprets how we spend our money.  Door prizes should be donated.  I do think someone stated in a workshop that we could not do any staff appreciation or teacher luncheons.  I don't know who said it and hopefully we can get correct information out to everyone.  We have sent a couple of email blasts to that effect.
 
 
 
 
 
 
 
  
 
 

 
GIFT CARD RULING:
On May 8th, 2008, Kathy Coffman, Treasurer of Texas PTA and Suzy Swan, Director of Finance for Texas PTA attended an IRS workshop on 501C3 organizations.  We were two of about 200 people attending and 600 people attended over a three day period.   As you can imagine we discussed every type of scenario for contributions, fund raising, appropriate expenditures, etc. 

With the changes for 990’s and the requirements for all 501C3 organizations, we found this workshop with three IRS agents from the non-profit division to be very informative.

The hardest thing we have to encourage every PTA to understand and enforce is NO GIFT CARDS!  PTA money cannot be used to purchase ANY type of gift card.  We did receive clarification on gift cards that are donated .  Gift cards are the same as cash.  Some PTAs have gift cards donated for silent auctions, etc.    The following is a direct quote from the IRS:

You can certainly accept the gift cards to auction off.  (However, the contributor may not necessarily be entitled to a deduction for the full amount of the gift card).  You would just give an acknowledgement of  receipt of the basket/ and or gift card.

 

Please understand that this is not Texas PTA’s decision, it is a directive from the IRS for 501C3 organizations. 
 
 
 
 
 
 
 
 
 
 
 

 
SECRETARIES AS CHECK SIGNERS:

I wanted to let you know about a recommendation that is being made by the National PTA. 

It is that secretaries not be signers on the PTA checking account.  Texas PTA is looking into it, but it is not yet a mandate. The Bylaws Committee will be taking it into consideration for inclusion in our bylaws.


The rationale behind it is that the secretary is the official keeper of the records and could make changes to records without anyone knowing, and therefore should not be a signer.


At this point, it is just something to be aware of, but not an official position or mandate of the Texas PTA.  This is just another way that a unit can protect itself from problems.

PTA FRAUD ALERT:

Someone is calling PTAs claiming to be a government collection agency and demanding payment of overdue state sales taxes. 

The Texas Comptroller's office does utilize a company for collections that does accept payments by phone, so it is possible a call may be legitimate.  To verify if you are being contacted by a legitimate agent of the Comptroller, call their office at 800-252-8880.
Please be very wary of any calls you may get regarding unpaid sales tax.
