Section 504

Section 504 is a civil rights law that prohibits discrimination against individuals with disabilities. Section 504 ensures that a child with a disability has equal access to an education.

Determination of Eligibility

To determine eligibility under Section 504, the committee of knowledgeable persons must consider all the following questions:

Does the learner have a physical or mental impairment?
Does the physical or mental impairment affect one or more major life activities including major bodily functions?
Does the physical or mental impairment substantially limit a major life activity? It is important to specifically identify what the substantial limitations are and how they impact learner performance and progress.
Does the learner require Section 504 services in order for his/her educational needs to be met as adequately as those of non-disabled peers.

Section 504 does not require a public school to provide students with disabilities with potential-maximizing education, only reasonable accommodations that give those students the same access to the benefits of a public education as all other students.” (J.D. v. Pawlet School District, 224 F.3d. 60, 33 IDELR 34 (2nd Cir. 2000)

Section 504 Request Process

Parents or former students requesting Section 504 records should contact the last campus the student attended. If the campus is unable to fulfill the request, please complete the Records Request Form below. Once your request is submitted, it will be verified, and you will receive an email notification once processing is complete.

This form is not intended for use by other campuses or school districts. Outside districts should submit records requests through the TREx system or SameGoal.

Los padres o ex alumnos que soliciten expedientes de la Sección 504 deben comunicarse con el último plantel escolar al que asistió el estudiante. Si el plantel no puede atender la solicitud, por favor complete el Formulario de Solicitud de Expedientes que aparece abajo. Una vez enviada la solicitud, será verificada y recibirá una notificación por correo electrónico cuando el proceso se haya completado.

Pursuant to Section 504 of the Rehabilitation Act of 1973, the District has a duty to identify, refer, evaluate and if eligible, provide a free, appropriate public education to disabled students. For additional information about the rights of parents of eligible children, or for answers to any questions you might have about identification, evaluation and placement into Section 504 programs, please contact the District’s Section 504 School Liaison.
